The finance bill published yesterday in the Republic of Ireland , deals with the issue of green diesel ( aka red diesel) tax as per the ending of an EU degrogation.
A tax of 36 euro cents ( appox) , bringing the cost of the diesel upto approc 1.13 euros per litre( on average) will be added. However this tax will be self certified and user reported. Users will continue to pay the rebated price to the seller of the diesel, keep the receipts , and pay the difference before 31march each year. it will remain legal to have "green " diesel ( marked gas oil) in the tank of a boat
The system is similar to that which is being introduced in the UK ( it is understood)
All in all a good "commonn sense" approach as sources of supply will be maintained and usage for heating etc can be deducted by the user.

What happens if foreign boat/owners fill up? Assume they don't have to pay the extra tax?

no the onnus will be on the foreign to make the retuen and pay the tax ( same as getting a speeding ticket , or getting income froma foreign country). merely being a foreigner doest absolve you of a another countrys tax. ( in lots of area)
However will foreigners pay it !!, Does anyone care!!

I think we can assume that they'd rather pay the tax and get a receipt so they will avoid large fines in Holland/Belgium/France etc. If they can't prove it's duty paid eg in Holland they get fined on the tank capacity, not the amount in it.
Getting a receipt in time to return to the continent might be problematic, tho' I suppose they could possibly get one from Customs before leaving.
Interesting scenario.

There will be no problem in Holland or elsewhere. It is and will be legal for you to have red diesel, whether the tax is paid or not is an issue for the country in which you bought it.
The case in Holland was an overzealous official who beleived that red diesel had been banned in the UK. He subsequently received a belt of a crown from HM and now all is well. going forward the situation will remain the same, you can enter the rest of teh EU with red diesel in your tanks, you just cant put any more in while you are there ( except Ireland of course)
