Purchase or use red diesel

I have a concern about some of the terminology used by some articles about the loss of deogation. I read that we will be "breaking the law to purchase" red for leisure use and then I read "breaking the law to use". Like most of us at the end of last season I filled my tanks fully to try to eliminate condensation so there she sits with just under 700 gal which will take me well into 07 season. What will happen say back end next July and I am still burning red at 1 GPH. Will I be locked up?
