Pensioner Prison
      #1838920 - 27/04/2008 17:53

Having long since retired, I spend and enjoy as much time as possible sailing my boat out in the Med, as I´m sure many of yourselves also have the pleasure of. I am domiciled however in the UK and live there for most of the year and was recently told by a friend of mine that new regulations state that, as a pensioner you can only leave UK soil for maximum period of 3 months at any one time, unless you sign off ? Are the liveaboard forumites/ liveaboard pensioners that cruise for months on end aware of any such rule?
Any information would be much appreciated.

Can't help you with that one Narcer, 12 months to go before state pension, but there's no restrictions on my service pension (as far as I know anyway.. ) I'm sure I've met pensioners out there who don't come home to uk every 3 months though, I thought as long as you pay tax and have a uk address it didn't matter how long you 'travel' abroad. I'm sure lot's winter there for 5-6 months every year

No such problem.
What do you mean sign off? My State pension gets paid directly into the bank account.

You should have no problem at all, pensions are paid to expats living in the EU along with health care entitlements, providing of course you have paid enough in!

Yes, and the sign off has to be from Gordon Brown personally or you are in trouble.

Seriously, where does this stuff come from??? I thought April 1st was long gone.

Are you talking about state retirement benefit or additional paymanys like housing benafit, winter fuel payments and the enhancements to meet garenteed min pension provision. As far as I am aware the only possible problem withe state retirement pension ifor ex-pats is that under some circumstances the can be frozen at the level at wich they where paid when you left UK but presumably not if you then reside in an RU state. The additional benifits may well have time limits for travel. For advide I would initialy aproach either citizens advice or help the aged, either should be able to advise you on the best way to maximise pension income whill also maximising sailing time.

No, not true: my parents received their state and private pension from the UK despite living in Italy for 15+ years. In all that time, they returned only once to the uk.

I think your friend may be confusing pensions with NHS rules which have been discussed ad nauseum on this Forum.

My State Retirement Pension, together with winter fuel allowance and Christmas bonus are paid into a French bank account in Euros.

Well...as far as I am aware, this information has come from the pension HQ in Newcastle. Apparantly, as a state pensioner (and this does not include additional benefits - only the standard state pension) you are allowed to wander freely outside of the UK for a total of 6 months within the year, after which you then have to notify the pension authorities in Newcastle as to your whereabouts beyond the 6 month period. I´ve been told that out of the 6 months "leave" you are only given a maximum 3 month period at any one time. I am now under the impression from this information that beyond this 6 month period you have to notify the authorities (Big Brother again) so they are aware you are not in the UK beyond this period of leave ?

I´m currently researching the web for more solid info - but the problem is that the rules are changed so quick these days!
