    Like the Scottish Merchant Flag, it would only be illegal if it was (a) a UK ensign or (b) other "distinctive national colours".

    Quite. Only last year Myself and Mental Pause encountered a French yacht on Windermere.

    He was flying a tricolour and we were naked.
    We felt so ashamed.

    The Act of Union came about because Scotland was broke. They had invested vast sums in trying to establish a colony in the American Ithsmus and it failed catastrophically taking much of Scotland's exchequer with it. The English bailed them out with the proviso that they became part of the "United Kingdom".
